OCBs shall be added.

As per regulation A person resident outside India, may transfer share or convertible debenture of an Indian company ,without the prior permission of the Reserve Bank ,by way of sale, to

a person resident in India subject to the adherence to pricing guidelines,

documentation and reporting requirements for such transfers as may be specified by Reserve Bank from time to time."

Issued regulation relating  to borrowing or lending in foreign exchange by any company registered under the Companies Act, 1956, other than a financial intermediary, NGOs engaged in micro business activities, any other entity specified by RBI.

The borrowing in foreign exchange by an entity shall not exceed USD 500 million or equivalent in any one financial year (April –Mar.).

The borrowings in foreign currency by NGO shall not

exceed USD 5 million or equivalent during a financial year (April – Mar.)

As per this notification if the shares or convertible debentures are not issued within 180 days from the date of receipt of the inward remittance or date of debit to NRE / FCNR (B) account, the amount of consideration so received shall be refunded to the person concerned by

outward remittance & Reserve Bank may, on an application made to it and for sufficient reasons permit an Indian company to refund the amount of consideration received towards issue of security, if such amount is outstanding beyond a period of 180 days from the date of receipt.

Reserve Bank may,  permit a person resident in India, to enter in to a freight derivative contract in an exchange or a market out side India to hedge the freight risk. Reserve Bank under sub-regulation (ii) of Regulation 6 may permit an oil refining company or a shipping company, resident in India, to enter in to freight derivative contracts in an exchange or market outside India, to hedge the freight risk.

(i) proceeds of inward remittances received from outside India through normal banking channels; and

(ii) Transfer of funds, from the rupee account of the diplomatic mission in India, which are collected in India as visa fees and credited to such account.”

(Second Amendment) Regulations, 2009

 

In Notification No.FEMA.3/2000-RB dated May 3, 2000 for clause AA, the following shall be substituted

"(AA) Borrowings in foreign exchange per borrower company per financial year up to such amounts not exceeding US Dollars 500 million or its equivalent as directed by the Reserve Bank from time to time shall be permitted for such permissible end-uses as indicated by Reserve Bank from time to time".

In sub-paragraph (A), in clause (a) The following sectors will qualify as infrastructure sectors, namely,(i) Power, (ii) Telecommunication, (iii) Railways, (iv) Road including Bridges, (v) Sea Port and Airport (vi) Industrial Parks (vii) Urban Infrastructure (water supply, sanitation and sewage projects) and (viii) Mining, Exploration and Refining”.

Foreign Security) (Fourth Amendment) Regulations, 2009

 

In Notification No. FEMA.120/RB-2004 dated July 7, 2004

in Regulation 7, following provision was  substituted, namely :-

"(1) Subject to the Regulations in Part I, an Indian Party engaged in financial services sector in India may make investment in an entity outside India:

Provided that the Indian party has earned profit from financial services for last 3 years & it must be registered and has fulfilled  the prudential norms prescribed by the regulatory authority in India.

"provided that they have not at any time violated any of the provisions of these regulations and no investigation is pending against them for contravention of the provisions of these regulations under the Act."

Foreign Exchange Management (Remittance of Assets) (Amendment) Regulations, 2009

 

In Notification No.FEMA.13/2000-RB dated May 3, 2000

in regulation 6 in sub-regulation (1) in clause (iii), in the Proviso, for clauses "C" and "D", the following shall be substituted, namely :-

"(C) no-objection or tax clearance certificate from income-tax authority for the remittance;

(D) confirmation from the applicant that no legal proceedings in any Court in India are pending and there is no legal impediment to the remittance ; and

(E) a report from the Registrar of Companies regarding compliance with the provisions of the Companies Act, 1956, in case of winding up of the office in India"

Foreign Exchange Management (Foreign Currency Accounts by a Person Resident in India) (Second Amendment) Regulations, 2009

 

In Notification No. FEMA 10/2000-RB dated 3rd May, 2000 in Regulation 7 for sub regulation 8 the following amendment is made :-

A citizen of a foreign State, resident in India employed by foreign company or Indian company may open, hold & maintain a foreign currency account with a bank outside India & remit salary to that account. But this income is taxable in India as accrued in India.

Immovable Property in India) (Second Amendment) Regulations, 2009

 

In Notification No. FEMA. 21/ 2000 -RB dated May 3, 2000

in regulation 2, clause (c), sub clause (ii), shall be substituted by the following, namely,-

" (ii ) who or either of whose father or mother or whose grandfather or grandmother was a citizen of India by virtue of the Constitution of India or the Citizenship Act, 1955 (57 of 1955)."

A new Regulation 12 regarding Pledge of shares of company Incorporated in India was inserted.

In Schedule 5 of the Principal Regulations, in paragraph 1, the existing provisos (i) and (ii) shall be deleted and provisos (iii) and (iv) shall be renumbered as (i) and (ii), respectively and shall be  deemed to have been deleted and renumbered with effect from the 17th day of October 2008
